I won by default in a doorstep of the trial BECAUSE MY MORON OPPONENT NEVER SHOWED UP!
Can you believe it?  Someone, please wake me...

Well, she will of course dispute the default and we'll be back in court by next Monday, you watch...

Okay.
A moron tried to climb a cliff in the mountains without using any rope or anyone's assistance. An EMT came to rescue him, fell off the same cliff and died. The EMT didn't know there was a cliff.
The defendant sort of negligently imperiled himself, hence the estate of the deceased can recover from the victim. That was my argument.

Well, it ain't over yet.

you are extremely lucky -- its a pretty weak case :) EMT are usually expected to go into the line of fire
