Опять в Москве каких-то геев разогнали...
Наш профессор по конституционному праву говаривал: "Я-то не уверен, но вы, ребята, с вероятностью доживете до того времени, когда sexual preferences станет конституционно защищенной категорией, по аналогии с расой, национальностью, религиозной принадлежностью, полом, итд".
Это я к тому, что, если вектор сохранится, у нашего побережья есть хороший шанс получить приток беженцев из России.

Yes, I do. If you don't mind. Which clause of the 1st Amendment protects the right to engage in homosexual sodomy?
Lawrence v. Texas answered precisely that question.

"heightened scrutiny" is not necessarily the same thing as intermediate, it can be O'Connors' "intermediate", Kennedy's "rationality with the bite" etc.

I am sorry for not engaging in that any further, I think a good con law textbook would answer all your questions. THompson West has a good one, 14th edition.

Oh really... And I was dumb enough it was a 14th Amendment issue. Stupid me.

It's all the same. ALL the same. 3 prongs + Califano byproduct 4th prong for sexual discrimination.
